Welcome to Ocean Hair (oceanhair.co.za). This website is operated by Ocean Hair. Throughout the site, the terms "we", "us", and "our" refer to Ocean Hair.
We provide services to you subject to the notices, terms, and conditions set forth in this agreement. In addition, you agree to abide by the rules, guidelines, policies, terms, and conditions applicable to such services before you use them.
Ocean Hair reserves the right to change this site and these terms and conditions at any time. Before proceeding, please read this agreement because accessing, browsing, or otherwise using the site indicates your agreement to all the terms and conditions in this agreement.
Terms of Usage
You shall not upload, distribute, or otherwise publish through this site any content, information, or other material that:
(a) includes any bugs, viruses, worms, trap doors, Trojan horses, or other harmful code or properties;
(b) is libelous, threatening, defamatory, obscene, indecent, pornographic, discriminatory, or could give rise to any civil or criminal liability under the laws of South Africa or the laws of any other country that may apply; or
(c) violates or infringes upon the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person.
Ocean Hair may provide you with an account identification and password to enable you to access and use certain portions of this site. Each time you use a password or identification, you are deemed to be authorized to access and use the site in a manner consistent with the terms and conditions of this agreement, and Ocean Hair has no obligation to investigate the source of any such access or use of the site.
By accepting these Terms of Use through your use of the site, you certify that you are 18 years of age or older. If you are under 18 years old, please use this site only under the supervision of a parent or legal guardian.
Subject to the terms and conditions of this agreement, Ocean Hair hereby grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the site by displaying it on your Internet browser only for the purpose of shopping and not for any commercial use or use on behalf of any third party, except as explicitly permitted by Ocean Hair in advance. Any violation of this agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Unless explicitly permitted by Ocean Hair in advance, all materials, including images, text, illustrations, designs, icons, photographs, programs, video clips, and written and other materials that are part of this site (collectively, the "Contents") are intended solely for personal, non-commercial use. You may not make any commercial use of any of the information provided on the site or make any use of the site for the benefit of another business. Ocean Hair reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Ocean Hair believes that customer conduct violates applicable laws or is harmful to Ocean Hair's interests.
You may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this site or any portion of it unless expressly permitted by Ocean Hair in writing.
You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you whether or not such access to and use of this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including without limitation financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Ocean Hair of any unauthorized use of your password or identification or any other breach or threatened breach of this site's security.
Ocean Hair sincerely respects property rights. In case there is a copyright infringement on any picture, please contact us, and we will remove the picture as soon as possible.
User Account
For safety and security, each customer is allowed to create only one registered account by default. For customers who attempt to create several accounts, Ocean Hair reserves the right to suspend accounts without further notice.
Both parties agree that, following order dispatch, transportation is the sole responsibility of the third-party logistics company. During this stage, full ownership of the product(s) belongs to the buyer; all associated liability and risks during transportation shall be borne by the buyer.
In accordance with customs regulations, customers must provide valid and accurate data. All consignee names, addresses, and payers' names should be valid. Certain countries request that the consignee submit their ID or passport to clear the package or for payment verification purposes. It is the customer's sole responsibility for the accuracy of data that they provide to us. Should any information be incorrect and prevent any shipment or deliveries or customs clearance, we will not be held responsible and will not offer any compensation in such cases.
Ocean Hair will always comply with the law, and we kindly remind users to do the same. As the importer, customers are responsible to comply with all laws and regulations in their own countries. Please refer to our privacy policy for more information.
Order Acceptance
Please note that there may be certain orders that we are unable to accept and must cancel. Ocean Hair reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.
Ocean Hair is not responsible for late deliveries for special occasions, such as birthdays or other events. We encourage customers to place their order in advance to ensure there is enough time to receive their item.
All orders reported as "delivered" by shipping companies are considered delivered. Ocean Hair cannot be held liable for non-delivery in this case.
Our Products
Product Representation
We strive to display product colors and details as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be precise. Slight variations in color, texture, and density are inherent to natural human hair products and are not considered defects.
We reserve the right to modify product descriptions, discontinue items, or limit quantities without prior notice.
Color & Texture Disclaimer
Natural human hair is distinct, and no two heads of hair are exactly alike. Our pictures are meant to give you a good idea of our textures. When you place an order with us, you will notice that there may be some variation between our pictures and the hair you receive. This is not avoidable, nor should it be. It is part of the beauty of wearing premium quality human hair. Our hair is beautiful and unique, just like you.

Reviews and Submissions
Except as otherwise provided elsewhere in this agreement or on the site, anything that you submit or post to the site and/or provide to Ocean Hair, including, without limitation, ideas, know-how, techniques, questions, reviews, comments, and suggestions (collectively, "Submissions") is and will be treated as non-confidential and non-proprietary.
By submitting or posting, you agree to irrevocably license the entry and all IP rights related thereto to Ocean Hair without charge, and Ocean Hair shall have the royalty-free, worldwide, perpetual, irrevocable, and transferable right to use, copy, display, publish, transmit, adapt, create derivative works from such Submissions by any means and in any form.
All Submissions shall automatically become the sole and exclusive property of Ocean Hair and shall not be returned to you. You warrant that your Submissions, in whole or in part, are clear and free of any IP right infringement, disputes, or third-party claims. Ocean Hair assumes no liability for any misuse of copyright or any other rights of third parties by you. You undertake to defend and indemnify Ocean Hair against any losses caused due to the use of the submissions for any purposes.
With the exception of your personal information, any communication or material you send to the Ocean Hair site, electronically or otherwise, including but not limited to data, questions, comments, or submissions, may be used by Ocean Hair for any purpose including but not limited to modification, reproduction, transmission, disclosure, publication, broadcast, and posting.
Packing and Transportation
Packing
Unless otherwise provided, Ocean Hair will comply only with its minimum packing standards for the method of transportation selected. The cost of all special packing, loading, or bracing requested by the buyer will be paid for by the buyer.
Transportation
Unless otherwise provided, Ocean Hair shall use its judgment in determining carrier and routing. In either case, Ocean Hair shall not be liable for any delays or excessive transportation charges resulting from its selection.
Payment Terms
All terms of payment are 100% upfront. Discounts apply only to the invoiced value of the material (not to taxes or freight charges). We accept all major credit cards and payment methods as indicated during checkout.
As soon as you place an order online, your payment method will be charged. We have zero tolerance for payment fraud and theft of our merchandise. Any fraudulent transactions will be prosecuted to the fullest extent of the law.
If your billing address differs from your shipping address, we may require additional verification before your order is released. This may delay the shipping of your order.
If the buyer fails to make payment in accordance with terms of this agreement, Ocean Hair may, at its option (and in addition to other remedies), cancel any unshipped portion of this order. The buyer remains liable for all unpaid accounts.
Order Processing
Our business hours are Monday through Friday. Orders placed over the weekend will be processed the next business day unless it is a holiday. Once shipped, orders arrive within the time frame selected at checkout.
Disclaimer of Warranties; Limitation of Liability
We do not guarantee, represent, or warrant that your use of our service will be uninterrupted, timely, secure, or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties, or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall we, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service.
Indemnification
You agree to indemnify, defend, and hold harmless Ocean Hair and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.
Force Majeure
Ocean Hair shall not be liable for failure to perform its obligations resulting directly or indirectly from or contributed to by acts of God; acts of buyer, civil or military authority, including wage and price controls; fires; war; riot; delays in transportation; lack of or inability to obtain raw materials, components, labor, fuel, or supplies; or other circumstances beyond Ocean Hair's reasonable control.
If certain quantities are affected and other quantities are not, the quantities affected shall be eliminated without liability, but the agreement shall remain unaffected. Ocean Hair may during any period of shortage due to any of said causes, allocate its supply of such raw materials among its various users thereof in any manner which Ocean Hair deems fair and reasonable. In no event shall Ocean Hair be liable for special or consequential damages for any delay for any cause.
Ocean Hair reserves the right to cancel or change any program without notice at any time.
Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the service constitute the entire agreement and understanding between you and us and govern your use of the service, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
Governing Law
When completing your purchase, a billing statement including 'Ocean Hair' and the country code, such as 'ZA' (South Africa) will be displayed on the payment page and/or your card statement.
